Tightens Wi-Fi Hotspot Licensing Rules After October 19 Deadline

The Uganda Communications Commission (UCC) is tightening licensing requirements for Wi-Fi hotspot operators who resell internet services, following the expiry of an October 19 deadline for unlicensed businesses to voluntarily stop providing telecommunications services.

UCC executive director Nyombi Thembo said the commission would introduce a registration system to distinguish home internet users from commercial operators, as it moves to address unlicensed internet resale and what it describes as unfair competition in the telecommunications sector.

The measures affect businesses that buy home internet packages and sell connectivity to neighbours and other customers for profit.

Operators who want to continue providing telecommunications services must meet the applicable licensing and regulatory requirements, including obtaining community licences where required by law.

The commission’s action focuses on the use of home internet packages for commercial purposes, a practice UCC says can distort market prices and compromise network quality.

Under the proposed framework, operators will be classified according to their service arrangements, distinguishing ordinary home internet use from commercial resale.

UCC plans to create a registration link through which hotspot operators can submit information about their service categories, package types, costs and applicable registration requirements.

The commission says the system will help clarify how businesses operating at different points in the internet distribution chain should be regulated.

The proposed categories are also intended to support a fairer distribution of costs among wholesale suppliers, intermediaries and downstream operators.

However, UCC has not yet provided the detailed categories, registration procedures, fees or documentation requirements that businesses will have to meet.

The date when the registration system will become operational has also not been announced.

Thembo announced the measures after a third meeting with Wi-Fi and hotspot operators affiliated with the Kampala City Traders Association (KACITA), the National Entrepreneurs and Traders Association (NETA), and other individuals involved in the business.

The discussions come as the commission seeks to bring internet resale businesses within the applicable regulatory framework.

“Offering telecommunications services without a valid licence is untenable,” Thembo said.

He said licensing was necessary to formalise businesses, promote sustainability and support fair competition.

The commission argues that unlicensed resale arrangements disadvantage licensed telecommunications companies that invest in network infrastructure and comply with regulatory obligations.

Thembo also emphasised that UCC recognises the challenges involved in running a business but expects operators to follow the rules.

“We are regulators with a human face who understand the drive required to build a business, but compliance is non-negotiable,” Thembo said.

UCC says operators will also be expected to observe fair-usage policies, declare taxes and protect network integrity.

The commission has linked the measures to consumer protection, data security and efforts to combat cyber threats.

The requirements place internet resale businesses under closer regulatory scrutiny, particularly those using residential packages to supply paying customers.

For operators seeking to remain in business, the immediate requirement is to establish which licences and regulatory obligations apply to their services.

UCC has said unlicensed operators must stop providing telecommunications services, while those wishing to continue must satisfy the relevant requirements.

The commission has not disclosed how many operators complied with the October 19 deadline or how many may still be operating without the necessary authorisation.

It has also not specified the enforcement measures or penalties that could be imposed on businesses that continue operating illegally.

These outstanding details leave questions about how the new framework will be implemented and how existing hotspot businesses will transition to the required arrangements.

The changes also have implications for customers who rely on resellers because commercial internet packages may be expensive or inaccessible to them.

UCC says its approach is intended to balance affordable internet access with the need to protect infrastructure investments and ensure that operators meet their tax and licensing obligations.

Whether the new requirements will affect the prices paid by customers remains unclear.

Alongside the registration system, UCC plans to establish a joint industry committee bringing together representatives of the commission, relevant government agencies, security agencies and seven hotspot operators.

The proposed committee will provide a platform for discussing operational challenges, improving communication and resolving disputes between businesses and regulators.

Its planned membership includes seven hotspot operators, although the commission has not announced their identities or provided a timeline for establishing the committee.

The initiative forms part of UCC’s wider engagement with businesses involved in internet resale, including operators affiliated with KACITA and NETA.

Further clarification from the commission will be needed on how the committee will operate and how hotspot businesses can raise concerns about licensing, service delivery and compliance.

UCC plans to introduce the registration link and service categories to distinguish home internet users from commercial operators.

The commission has also said that unlicensed businesses must stop providing telecommunications services unless they meet the applicable regulatory requirements.

The implementation date for the registration system, detailed licensing procedures and consequences for continued non-compliance remain unannounced.

For now, UCC Wi-Fi hotspot licensing remains central to the commission’s effort to formalise internet resale businesses while addressing competition, network integrity and consumer protection.

The next steps will depend on how the commission translates its announced plans into operational requirements and clarifies what existing and prospective hotspot operators must do to comply.

The Uganda Communications Commission (UCC) is tightening licensing requirements for Wi-Fi hotspot operators who resell internet
